Chapter I General Provisions
Article 1 in accordance with the Cleaner Production Promotion Law of the people's Republic of China, cleaner production audit measures and cleaner production audit evaluation and acceptance guidelines (HBJ [2018] No. 5), in order to scientifically standardize the promotion of compulsory cleaner production audit in Hainan Province, implement the guiding opinions on accelerating cleaner production (qiongfu ban Han [2021] No. 5), Promote the realization of carbon peak and carbon neutralization, standardize the working procedures and requirements of cleaner production audit, guide the relevant work of mandatory cleaner production audit, and formulate these guidelines in combination with the actual situation of Hainan Province.
Article 2 the cleaner production audit mentioned in these Guidelines refers to the investigation and diagnosis of the production and service process according to certain procedures, find out the causes of high energy consumption, high material consumption and heavy pollution, and put forward plans to reduce energy consumption, material consumption and waste generation, as well as the use and generation of toxic and harmful materials and the resource utilization of waste, The process of selecting and implementing technically, economically and environmentally feasible cleaner production schemes.
Cleaner production audit is divided into Voluntary Audit and mandatory audit.
Article 3 enterprises are encouraged to voluntarily carry out cleaner production audit.
Article 4 these guidelines are applicable to enterprises that should implement compulsory cleaner production audit, that is, those that comply with paragraph (1) of Article 27 of the Cleaner Production Promotion Law of the people's Republic of China "where the discharge of pollutants exceeds the national or provincial discharge standards, or although they do not exceed the national or provincial discharge standards, they exceed the total discharge control indicators of key pollutants" (hereinafter referred to as "Shuangchao") and "enterprises that use toxic and harmful raw materials for production or discharge toxic and harmful substances in production" (hereinafter referred to as "Shuangyou") in paragraph (3), as well as the ecological environment management departments engaged in cleaner production related activities in this province and the consulting service institutions assisting enterprises in organizing cleaner production audit.
Article 5 cleaner production audit shall take enterprises as the main body, follow the principles of combining Voluntary Audit with compulsory audit, and combining independent audit with external assistance audit, adjust measures to local conditions, carry out in an orderly manner and pay attention to practical results.
Chapter II Implementation of compulsory cleaner production audit
Article 6 the list of enterprises implementing compulsory cleaner production audit as stipulated in these Guidelines shall be determined by the Provincial Department of ecological environment before December 31 of each year, copied to the comprehensive cleaner production coordination department and industry management department at the same level, and published in batches on the official website of the Provincial Department of ecological environment or the provincial cleaner production management platform or in other ways convenient for the public to know. The municipal and County Ecological Environment Bureau shall notify the enterprise in writing according to the territorial principle.
Article 7 enterprises included in the list of compulsory cleaner production audit shall log in to the provincial cleaner production management platform, fill in the registration form of compulsory cleaner production audit (see attached table 1), and publish the relevant information of the enterprise on the official website of the enterprise, the provincial cleaner production management platform or local media or in other ways convenient for the public to know.
(1) For the "double super" enterprises implementing compulsory cleaner production audit, the main information published includes: enterprise name, legal representative, enterprise address and contact information, name of discharged pollutants, discharge mode, discharge concentration and total amount, exceeding the standard and exceeding the total amount.
(2) For the "dual owned" enterprises that implement compulsory cleaner production audit, the main information published includes: enterprise name, legal representative, enterprise address and contact information, name, quantity and purpose of toxic and harmful raw materials, name, concentration and quantity of toxic and harmful substances discharged, generation and disposal of hazardous wastes, Implementation of environmental risk prevention and control measures according to law, etc.
(3) Enterprises that also meet the conditions in categories (I) and (II) of this article shall publish relevant information at the same time with reference to the above requirements.
Article 8 according to the different production processes of enterprises and the degree of impact on the environment, it is divided into mandatory cleaner production routine audit (hereinafter referred to as routine audit) and mandatory cleaner production rapid audit (hereinafter referred to as rapid audit). Enterprises with simple production process, low energy consumption and less impact on the environment can implement rapid audit.
The list of enterprises implementing routine audit and rapid audit shall be determined by the Provincial Department of ecological environment.
Article 9 in principle, the compulsory cleaner production audit procedures include audit preparation, pre audit, audit, scheme generation and screening, scheme determination, scheme implementation, continuous cleaner production, etc. Enterprises that implement rapid audit can simplify the scope, content and steps of audit and carry out audit work.
Article 10 enterprises included in the list of mandatory cleaner production audit shall conduct audit within two months after the list is published.
For "dual owned" enterprises that implement compulsory cleaner production audit, the interval between two audits shall not exceed five years.
Article 11 enterprises implementing routine audit shall complete this round of cleaner production audit within one year from the date of publication of the list, log in to the provincial cleaner production management platform and upload the cleaner production audit report.
Enterprises implementing rapid audit shall complete this round of cleaner production audit within eight months from the date of publication of the list, log in to the provincial cleaner production management platform and upload the cleaner production audit report.
Chapter III compulsory cleaner production audit and evaluation
Article 12 the mandatory cleaner production audit and evaluation mentioned in these Guidelines refers to the standardization of the cleaner production audit report and the authenticity of the cleaner production audit process after the enterprise has basically completed the cleaner production no / low cost scheme and at the time node after the feasibility analysis of the cleaner production medium / high cost scheme and before the implementation of the medium / high cost scheme The process of technical review on the rationality and feasibility of cleaner production medium / high cost scheme and implementation plan.
Article 13 an enterprise under any of the following circumstances shall submit an application for compulsory cleaner production audit and evaluation to the municipal and County Ecological Environment Bureau at the same time of uploading the cleaner production audit report.
(1) Enterprises that need to carry out compulsory cleaner production audit are clearly pointed out in the national assessment plan and action plan.
(2) Enterprises applying for financial funds for cleaner production, energy conservation and emission reduction at all levels.
Article 14 enterprises applying for compulsory cleaner production audit and evaluation shall log in to the provincial cleaner production management platform and submit the following materials:
(1) Application for mandatory cleaner production audit and evaluation (see attached table 2 for the application form).
(2) Cleaner production audit report.
(3) Enterprises that organize and carry out the audit by themselves shall provide the supporting materials in paragraphs (2) and (3) of Article 16 of the cleaner production audit measures.
Article 15 the compulsory cleaner production audit and evaluation shall include but not limited to the following contents:
(1) Whether the cleaner production audit process is true and the method is reasonable; Whether the cleaner production audit report can truthfully and objectively reflect the basic situation of enterprises carrying out cleaner production audit, etc.
(2) Whether the production level, emission concentration and total amount of pollutants, energy and material consumption level, use and emission of toxic and harmful substances of the enterprise are objectively and scientifically evaluated; Whether the selection of cleaner production audit focus reflects the main problems existing in energy, resource consumption, waste generation and pollutant emission; Whether the setting of cleaner production objectives is reasonable, scientific and standardized; Whether the cleaner production management level of enterprises has been improved.
(3) Whether the proposed medium / high cost scheme of cleaner production is scientific and effective, whether the feasibility is fully demonstrated, and whether the selected cleaner production scheme can support the realization of cleaner production objectives. "Double super" enterprises demonstrate the effect of implementing cleaner production scheme, and explain whether they can realize the pollutant emission reduction target within the specified time limit; "Double owned" enterprises demonstrate the effect of implementing cleaner production scheme, and explain whether they can replace or reduce the use of toxic and harmful raw and auxiliary materials and the discharge of toxic and harmful pollutants.
(4) Application and implementation of pollutant discharge permit: whether to explain the application and implementation of pollutant discharge permit, whether to carry out self-monitoring according to the permit requirements, etc.
(5) Carbon emission evaluation and analysis: whether to reduce the generation and emission of carbon dioxide and evaluate it.
Article 16 the evaluation results of compulsory cleaner production audit are divided into "qualified" and "unqualified". Enterprises with a comprehensive score of less than 70 are determined as "unqualified", and enterprises with a comprehensive score of more than 70 (inclusive) are determined as "qualified".
If the comprehensive score is lower than 70, the routine audit shall be carried out again; Enterprises with a comprehensive score of 70-90 shall modify the audit report according to the expert opinions within one month. After being submitted to the competent department for review, the modified cleaner production audit report (stamped with official seal), cleaner production scheme performance table (see attached table 4, the performance data in the table shall be modified according to the expert group opinions) and modification instructions shall be uploaded to the provincial cleaner production management platform; Enterprises with a total score higher than 90 can directly upload the modified cleaner production audit report and cleaner production scheme performance table (the performance data in the table shall be modified according to the opinions of the expert group) to the provincial cleaner production management platform, and promote the implementation of medium / high cost schemes according to the scheme implementation plan.
Article 17 the list of enterprises identified as "qualified" by the evaluation results shall be published in batches on the official website or the provincial cleaner production management platform after being approved by the special meeting of the Provincial Department of ecological environment.
Chapter IV compulsory cleaner production audit and acceptance
Article 18 The term "compulsory cleaner production audit and acceptance" as mentioned in these Guidelines refers to the process of comprehensively evaluating the performance of the implemented cleaner production scheme, the realization of cleaner production objectives and the cleaner production level of the enterprise and making concluding comments after the enterprise implements the medium / high cost cleaner production scheme according to certain procedures.
Article 19 enterprises that meet the provisions of Article 13 of these Guidelines shall log in to the provincial cleaner production management platform and submit an acceptance application to the municipal and County Ecological Environment Bureau within one year after passing the evaluation.
Article 20 enterprises applying for compulsory cleaner production examination and acceptance shall submit the following materials:
(1) Application for compulsory cleaner production audit and acceptance (the application form is attached table 3).
(2) Technical review opinions on cleaner production audit and evaluation.
(3) Cleaner production audit report.
(4) Cleaner production audit and acceptance report.
Article 21 the compulsory cleaner production audit and acceptance shall include but not limited to the following contents:
(1) Verification of cleaner production performance: after implementing the cleaner production plan, the enterprise shall evaluate whether it has achieved the expected pollutant emission reduction targets and energy-saving targets set during the cleaner production audit, and whether it has implemented the reduction and emission reduction targets of toxic and harmful substances; Verify the actual operation effect of the medium / high cost scheme of cleaner production and evaluate the environmental and economic benefits before and after the implementation of the cleaner production scheme;
(2) Determination of cleaner production level: for industries that have issued cleaner production evaluation index system, the evaluation index system is used to evaluate the cleaner production level of enterprises in the industry; For industries that have not published the cleaner production evaluation index system, the cleaner production level positioning of enterprises in the industry can be evaluated with reference to the industry statistical data.
Article 22 The results of compulsory cleaner production audit and acceptance are divided into "qualified" and "unqualified". For enterprises with a comprehensive score of 60 or above, the acceptance result is "qualified". If one of the following conditions exists but is not limited to, the acceptance is unqualified:
(1) The enterprise has fraud in the implementation of the plan.
(2) The pollutant discharge of the enterprise fails to meet the standard or the total pollutant discharge exceeds the specified limit.
(3) The enterprise does not meet the industrial policy requirements of production technology, equipment and products formulated by the state or Hainan Province.

(5) From the beginning of cleaner production audit to acceptance, the enterprise has committed environmental violations and failed to complete the rectification task within a time limit.
(6) Other relevant negative contents stipulated by Hainan Province.
Enterprises whose acceptance results are "unqualified" shall be included in the list of mandatory cleaner production audit for the next year to continuously promote cleaner production.
Article 23 the list of enterprises whose acceptance results are recognized as "qualified" shall be published in batches on the official website or the provincial cleaner production management platform after being approved by the special meeting of the Provincial Department of ecological environment.
Chapter V organization and management of compulsory cleaner production audit

Article 24 the Provincial Department of ecological environment is responsible for organizing and carrying out the compulsory cleaner production audit of "double super" and "double owned" enterprises.
Article 25 the municipal and County Ecological Environment bureaus shall carry out in-process supervision and management of the enterprises that implement the compulsory cleaner production audit, and regularly report the compulsory cleaner production audit, evaluation and acceptance of the enterprises within their jurisdiction to the Provincial Department of ecological environment.
The term "in-process supervision and management" as mentioned in these Guidelines refers to the supervision and guidance of the municipal and County Ecological Environment Bureau to the enterprises to carry out the audit work according to the schedule according to the territorial responsibilities.
Article 26 the municipal and County Ecological Environment Bureau shall conduct a preliminary examination on the integrity of the application materials for assessment or acceptance submitted by the enterprise.
If the preliminary review fails, the municipal and County Ecological Environment Bureau uploads the preliminary review opinions through the provincial cleaner production management platform, and the enterprise resubmits the application for evaluation or acceptance after supplementing and improving the materials according to the preliminary review opinions.
For enterprises carrying out rapid audit, assessment or acceptance, the Provincial Department of ecological environment shall organize experts or entrust professional institutions to establish an assessment or acceptance expert group, hold a centralized assessment technical review meeting or acceptance meeting, and issue assessment technical review opinions or acceptance opinions.
Article 28 enterprises that cannot complete the mandatory cleaner production audit on time shall log in to the provincial cleaner production management platform, submit an extension application, and submit a written explanation to the local ecological environment bureau. The municipal and County Ecological Environment Bureau shall issue opinions, which shall be included in the audit list of the next year after being approved by the provincial ecological environment department.
Article 29 enterprises are encouraged to carry out mandatory cleaner production audit by themselves. Enterprises that do not have the ability to carry out audit independently may hire external experts or entrust consulting service institutions to assist in the audit.
For enterprises that conduct mandatory cleaner production audit by themselves, the audit report shall meet the requirements of relevant preparation specifications. The auditors shall have strong professional knowledge of environmental protection and energy conservation, master cleaner production theories and policies, be familiar with cleaner production audit methods and procedures, and be able to organize relevant internal departments and personnel or hire relevant experts to carry out cleaner production audit.
The consulting service institutions assisting enterprises in organizing and carrying out compulsory cleaner production audit shall meet the relevant requirements of the state and Hainan Province, carry out cleaner production publicity and training for enterprises, assist enterprises in diagnosing the current situation of energy conservation and emission reduction and data analysis, tap the potential of cleaner production, formulate cleaner production objectives and put forward cleaner production plans, Help establish a sustainable cleaner production mechanism, etc.
Article 30 a consulting service institution that assists an enterprise in organizing the compulsory cleaner production audit shall meet the following conditions:
(1) It has independent legal personality and has a quality assurance system and management system to provide fair, fair and efficient services for enterprise cleaner production audit.
(2) Have basic detection and analysis instruments, equipment or means to carry out cleaner production audit, material balance test, energy and water balance test.
(3) Have technicians who are familiar with the production process, technical regulations and management requirements of energy conservation, water conservation and pollution prevention in relevant industries.
(4) Have technicians who master cleaner production audit methods and have cleaner production audit consulting experience.
Article 31 the Provincial Department of ecological environment shall organize experts or entrust professional institutions to regularly supervise and manage the consulting service institutions.
If a professional institution has an interest relationship with the consulting service institution entrusted by the enterprise, it shall take the initiative to avoid it.
Article 32 the members of the expert group shall be selected from the national or provincial cleaner production expert database, and shall be composed of experts who are familiar with the industry, cleaner production, energy conservation and environmental protection, and have senior titles or intermediate titles with more than 10 years of working experience. The members of the expert group shall not be less than 3.
If the experts participating in the evaluation or acceptance or centralized technical review have an interest relationship with the enterprise and its entrusted consulting service institution, they shall take the initiative to withdraw.
Chapter VI others
Article 33 enterprises carrying out compulsory cleaner production audit may apply for similar special financial funds for cleaner production, energy conservation and emission reduction in Hainan. Under the same conditions, the ecological and environmental departments at all levels shall give priority to the enterprises whose cleaner production level has reached the first-class level or the international leading level in terms of special funds
Article 34 enterprises whose cleaner production level has reached the first-class level or the international leading level shall be included in the positive list of supervision and law enforcement.
Article 35 on the basis of completing the tasks of emission reduction and energy conservation of major pollutants, enterprises can enter the surplus indicators into the emission right and energy use right trading market for trading in accordance with relevant regulations, Or the pollutant emission indicators required for the capacity expansion required by the enterprise's own development and the new output of new products.
Article 36 the department or unit undertaking the evaluation and acceptance work shall not charge fees from the enterprise.
Article 37 enterprises or consulting service institutions or relevant staff members who violate the Cleaner Production Promotion Law of the people's Republic of China and other relevant laws and regulations shall be investigated for legal responsibility by the ecological environment law enforcement department in accordance with the relevant laws and regulations.
Chapter VII supplementaryArticle 38 the Provincial Department of ecological environment shall be responsible for the interpretation of these guidelines and shall implement them from December 1, 2021.
